The judge in her decision found that Erika had no fiduciary duty to Sheldon and Finn, which is the obligation of one party to act in the best interest of another party.

“The Court finds that there is no justifiable question of fact that Ms. Girardi had ‘actual knowledge’ of the plaintiffs’ claims regarding the existence of a fiduciary duty between the plaintiffs and [Girardi and Girardi & Keese]’, the ruling said.

“The Court therefore enters summary judgment in favor of defendant Erika Girardi,” he added.
